Attorney: Due to a conflict of interest, William Barr must recuse himself from Lev Parnas' criminal caseAn attorney for Lev Parnas, the indicted associate of Rudy Giuliani, sent a letter to Attorney General William Barr on Monday, requesting the he recuse himself from Parnas' criminal case.Parnas was arrested last October and charged with campaign finance violations. In the letter, which was also filed in New York federal court, attorney Joseph Bondy said Barr has a conflict of interest and asked that a special prosecutor from outside the Justice Department handle Parnas' case. "Federal ethics guidelines bar federal employees from participating in matters in which their impartiality could be questioned, including matters in which they were personally involved or about which they have personal knowledge," Bondy wrote.Bondy cited several reasons why Barr should recuse himself, noting that the reconstructed transcript released by the White House of President Trump's July phone call with Ukrainian President Volodymyr Zelensky shows Trump telling Zelensky that Barr could help him facilitate an investigation into former Vice President Joe Biden. Last week, Parnas told MSNBC host Rachel Maddow that Barr knew about efforts in the Ukraine to dig up dirt on Biden, saying, "Attorney General Barr was basically on the team." Lev Parnas says Attorney General William Barr was 'basically on the team'Lev Parnas, the indicted associate of Rudy Giuliani, says he told Ukrainian oligarch Dmytro Firtash that in exchange for information that could discredit Special Counsel Robert Mueller's Russia investigation, he would try to stop Firtash's extradition to the U.S. to face corruption charges.Firtash, who is believed to have ties to the Russian mob, was in Vienna fighting extradition. During an interview with MSNBC's Rachel Maddow on Wednesday, Parnas said he was told Firtash's camp claimed to have evidence that one of Mueller's prosecutors was doing some "illegal stuff," and he was tasked with securing this evidence. John Solomon, a conservative columnist who pushed conspiracy theories, gave him documentation to show Firtash he "was in the loop," Parnas said.Parnas conveyed to Firtash that they believed he "was being prosecuted for no reason," and "basically, it could be taken care of," meaning they could stop the extradition. Parnas then worked to get conservative husband-and-wife lawyers Victoria Toensing and Joe diGenova on Firtash's legal team. Toensing and diGenova, staunch supporters of President Trump, also represent Solomon. Parnas said he was told to negotiate $ 1 million for the couple, plus $ 100,000 a month in expenses. He received $ 200,000.Giuliani, meanwhile, was working in Ukraine to dig up dirt on former Vice President Joe Biden and his son Hunter, and Parnas said they wanted Firtash to pressure Ukraine into announcing an investigation into the Bidens. If a director tries to run an investigation, it can get mucked up in other kinds of ways given his or her responsibilities and the impossibility of reaching the work being done at the lower levels.”But speaking Wednesday with Fox News’ Martha McCallum, Barr disagreed with Comey’s characterizations, especially the former FBI director's claim that he was “seven layers” above the investigation.“One of the problems with what happened was precisely that they pulled the investigation up to the executive floors, and it was run and birddogged by a very small group of very high-level officials,” Barr said. “The idea that this was seven layers below him is simply not true.”In his interview with Wallace, Comey also claimed the attorney general had made "an irresponsible statement” when he said last week that the errors laid out in the IG report allow “the possibility that there was bad faith.”Barr "does not have a factual basis as the Attorney General of the United States to be speculating that agents acted in bad faith," Comey said. In an op-ed published December 9, he stated “Attorney General William P. Barr owes . . . the American people, an acknowledgment of the truth.”In the Wednesday interview, Barr said it is “nonsense” that he is “somehow attacking the FBI” for wanting to investigate the origins of the bureau’s probe into the 2016 Trump campaign."We’re criticizing and concerned about misconduct by a few actors at the top of the FBI, and they should be criticized if they engaged in serious misconduct,” Barr said.The attorney general also confirmed that U.S. Attorney John Durham, who was tapped by Barr to lead an investigation into the original probe, was broadening his scope to look at other intelligence agencies.“He’s not just looking at the FBI, he’s looking at other agencies, and departments, and also private actors, so it’s a much broader investigation,” Barr said. “Also, it’s not just looking at the FISA aspect of it, he is looking at all the conduct both before & after the election"Following the release of Horowitz’s report, Durham caused waves by saying his team did “not agree” that the FBI had an “authorized purpose” for opening its investigation.
